Who must license their business in the state of Utah?

Generally, businesses license with the local municipality in which they are doing business. General standards exist for licensure, but each city also has unique requirements and procedures.

What is a business license?

The City grants permission to an applicant to engage in a business activity at a specific location within the City – a fee is charged and a paper license is provided. The definition of a business includes every trade, occupation, profession, or activity engaged in for commerce. A business may be inspected and required to fulfill local zoning, building, safety and health requirements before being issued a license.

Can I operate a business from my home?

Home Occupation Business Licenses are specifically designed for those that want to operate a business from their home.

What Home Based businesses in Ivins City are required to have a license?

Any business that involves:
1. Those under the age of 18 (pre-school, day-care, piano lessons, swimming lessons, etc.)
2. Adult senior care (care for senior citizens that may be taken advantaged of due to age or health).
3. Bed & Breakfast, etc. (overnight stay in a personal residence for a fee).
4. The nature of the business requires a fire inspection, i.e., blow torch or welder use, or other type of activity that could create a fire hazard as a part of the business activity.

Home based businesses that do not meet these requirements are not required to license but may choose to do so. Any business that operates from a commercial location must be licensed.

How much does a business license/permit cost?

New Home Occupation $50.00 (+ $40.00 fire inspection when required).
Annual Renewal $25.00 (+ $40.00 fire inspection when required).
New Commercial $50.00 + $40.00 fire inspection = $90.00.
Annual Renewal $25.00 + $40.00 fire inspection = $65.00.
Handbill Distribution Permit $25.00 – valid for 30 days. $25.00 – renewable for 1 year.
Residential Solicitation Permit $25.00 – valid for 1 year from date of issue.

What types of business licenses require a Background Criminal Identification (BCI) report?

Background reports are required for the following business types or activities:
1. Distribution of any beverage containing alcohol i.e., beer, and liquor.
2. Residential solicitation. A current BCI (less than 180 days since issued) from the state of residency for non-Utah residents and from the State of Utah for residents.
3. Owners and all employees of sexually oriented businesses including dancers.
4. Providers of care or instruction for anyone under the age of 18. (pre-school, day-care, teach piano lessons, etc.)
